Terms of Use & EULA

These Terms of Use and End User License Agreement ("Terms", "EULA") govern your use of the Face Grade iOS application ("Face Grade", "the App") and related services. By installing or using Face Grade, you agree to these Terms. These Terms constitute the binding agreement between you and the operator of Face Grade; Apple Inc. is not a party to these Terms.

1. Acceptance

By installing, accessing, or using Face Grade, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you must have a parent or guardian's permission to use the App.

2. License

Face Grade grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, in accordance with these Terms and Apple's standard application license.

3. Subscriptions

3.1 Plans and pricing

Face Grade offers recurring subscription plans billed weekly, monthly, or yearly at the prices shown inside the App. Prices include applicable taxes where required.

3.2 Payment

Payments are processed by Apple through your Apple ID. By subscribing, you authorize Apple to charge the stored payment method for the listed amount and any applicable taxes.

3.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Renewal charges are billed within 24 hours of the end of the current period.

3.4 Cancellation

You can cancel at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period; you retain access until that date. No partial refunds are issued for unused portions of a billing period unless required by applicable law.

3.5 Refunds

All refund requests are handled by Apple under the App Store's refund policy. Face Grade cannot issue refunds directly.

3.6 Free trials and promotions

Where offered, free trials convert to paid subscriptions unless canceled before the trial ends. Promotional offers are subject to their specific terms and may be withdrawn at any time.

4. Your content

You retain all rights to photographs you submit to Face Grade. By submitting a photograph, you grant Face Grade a limited, temporary license to process the image for the sole purpose of generating the analysis you requested. Photographs are not retained on our servers after processing.

You are responsible for ensuring that any photograph you submit is either of yourself or that you have the explicit consent of the subject. Submitting photographs of third parties without consent is prohibited.

5. Acceptable use

• You agree not to reverse engineer, decompile, or attempt to extract the source code of the App except as permitted by applicable law.
• You agree not to use the App to harass, defame, or otherwise harm any person.
• You agree not to submit unlawful content, including sexually explicit material, material depicting minors in any manner inconsistent with applicable law, or content that infringes third-party rights.
• You agree not to use automated means to access, scrape, or otherwise interact with the App or its services.

6. Nature of the analysis

Face Grade produces a neutral face-geometry report derived from visible geometric measurements and model-assisted observations. The output is not a medical, psychological, or professional assessment. It is not a diagnosis. It is not advice. Use of Face Grade does not create a professional relationship between you and Face Grade.

The App is intended as a technical reference for personal review of one still image. Do not use Face Grade as a substitute for guidance from qualified medical, psychological, dental, or other licensed professionals.

7. Disclaimers

Face Grade is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free, or that results will meet your expectations.

8. Limitation of liability

To the maximum extent permitted by law, Face Grade and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App. Our total liability to you for any claim arising from these Terms or the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any breach of these Terms. Upon termination, your right to use the App ends, though sections regarding intellectual property, disclaimers, limitation of liability, and governing law survive.

10. Intellectual property

All rights in and to the App, including code, design, branding, and documentation, belong to Face Grade or its licensors. Nothing in these Terms grants you any rights in Face Grade's intellectual property beyond the limited license in Section 2.

11. Changes

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, announced in-app. Continued use after a change constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Face Grade's operator is established, without regard to conflict-of-laws principles. Disputes shall be resolved in the courts of that jurisdiction, subject to any mandatory local consumer protection rights you may have.
